Palefest 2026 — Official Terms and Conditions

Applicable to all attendees, vendors, guests, performers, and participants at Palefest held on July 24th & 25th, 2026 at Land of Illusion Adventure Park (Middletown, Ohio).
By entering the premises, you agree to the following Terms and Conditions.

1. Assumption of Risk

By attending Palefest 2026, all attendees, vendors, guests, and performers (collectively, “Participants”) acknowledge and accept that participation involves inherent risks. These may include—but are not limited to—personal injury, property damage, illness, theft, accidents, and hazards associated with large-scale entertainment events and outdoor attractions.

By entering the property of Land of Illusion Adventure Park, Participants expressly assume all such risks and agree to hold harmless and waive liability against:

  • Paleface & Co. LLC

  • The House of Masks

  • AJ Good

  • Bishop Walker

  • Land of Illusion Adventure Park and its ownership

  • Employees, volunteers, security, vendors, contractors, associates, and affiliates of Palefest and Land of Illusion

(collectively referred to as “the Organizers”).

2. Release of Liability

To the fullest extent permitted by Ohio law, all Participants waive any and all claims against the Organizers for injuries, damages, losses, or liabilities that may arise from participation in Palefest 2026.

This includes—but is not limited to—claims involving:

  • Personal injury

  • Property damage

  • Illness

  • Theft

  • Death

  • Accidents

  • Negligence

  • Actions of third parties

Participants understand that they enter the property and participate entirely at their own risk, and agree that the Organizers cannot be held liable for any resulting harm.

3. Compliance with Festival Rules & Policies

All Participants must follow all posted rules, verbal instructions from staff, safety guidelines, and local laws.

Failure to comply may result in:

  • Immediate removal from the property

  • Permanent trespass

  • Loss of tickets, fees, or vendor payments without refund

  • Possible legal action depending on severity

The Organizers have full authority to determine what constitutes a violation.

4. No Refund Policy

All sales are final within 60 days of the event.

This includes, but is not limited to:

Attendees

  • All tickets are non-refundable, regardless of reason (schedule conflict, inability to attend, dissatisfaction, weather, etc.).

  • Event proceeds rain or shine.

Vendors

  • Vendor deposits and booth fees become non-refundable 60 days prior to the event.

  • Failure to comply with vendor rules, licensing, or documentation requirements will not qualify for a refund.

  • Cancellation within 60 days results in forfeiture of all paid fees.

  • all due dates and deposite dates and refund dates are subject to change year by year.

5. Code of Conduct

Palefest is a safe, family-friendly environment. All Participants must:

  • Act respectfully toward others

  • Avoid harassment, threats, discrimination, or aggressive behavior

  • Not endanger others through reckless or unsafe actions

  • Avoid lewd, abusive, or vulgar language directed at individuals

  • Follow all instructions from staff and security

Examples of prohibited behavior include, but are not limited to:

  • Fighting

  • Harassment (verbal, physical, or sexual)

  • Destruction of property

  • Intoxicated or disorderly behavior

  • Illegal drug use

  • Any activity that threatens safety

Violations will result in immediate removal without refund and may involve law enforcement.

6. Health & Safety Compliance

All Participants must comply with health, safety, and sanitation guidelines. Vendors must comply with all local health department requirements and Land of Illusion operational rules.

The Organizers may modify health protocols at any time if deemed necessary for public safety, and Participants agree to comply with revised guidelines.

7. Photography, Video, & Media Release

By entering Palefest 2026, Participants consent to being photographed, filmed, or recorded. Such media may be used by the Organizers for promotional, commercial, archival, or advertising purposes without compensation.

Participants waive any rights to royalties, approval, or review of such media.

8. Force Majeure

If Palefest must be postponed, canceled, or modified due to circumstances beyond the Organizers’ control—including but not limited to extreme weather, natural disasters, acts of God, pandemics, acts of terrorism, or government restrictions—all fees remain non-refundable.

The Organizers will make reasonable efforts to offer rescheduled dates or alternative arrangements.

9. Modification of Terms

The Organizers reserve the right to update, modify, or amend these Terms & Conditions at any time. Updates will be posted on the official Palefest website and available onsite.

Participation after modifications implies acceptance of all updated Terms.

10. Indemnification

Participants agree to indemnify and hold harmless the Organizers from any claims, damages, liabilities, or expenses—including attorney fees—arising out of:

  • The Participant’s actions or negligence

  • Violations of event rules

  • Damage caused to property, equipment, or individuals

  • Illegal activity or misconduct

This indemnification applies to Participants and all associated representatives, employees, heirs, and assigns.

11. Applicable Law

These Terms & Conditions are governed by the laws of the State of Ohio.
Any legal disputes must be resolved in the appropriate courts of Ohio.

Agreement

By entering Land of Illusion Adventure Park during Palefest 2026, you acknowledge that you have read, understood, and agree to these Terms and Conditions. This agreement applies to all Participants, including minors under your supervision.
